This website is operated by Millaracing Distribution LLC. Throughout the site, the terms "we", "us", "our" and "Millaracing" refer to Millaracing Distribution LLC. We offer this website, including all information, tools and services available from it, to you, the user, on the condition that you accept all terms, conditions, policies and notices stated here.

By visiting our site or buying from us, you agree to be bound by these Terms and Conditions ("Terms"), including our Shipping Policy, Return and Refund Policy and Privacy Policy, which are part of these Terms. These Terms apply to all users of the site, including browsers, customers, vendors, merchants and contributors of content. Please read them before you use the site or place an order. If you do not agree to all of them, do not use the site.

We may update these Terms at any time by posting the changes on this page. The version in effect when you place an order applies to that order. Your continued use of the site after a change means you accept it. Our store is hosted on Shopify Inc., which provides the e-commerce platform we use to sell to you.

1. Online store terms

  • You confirm that you are at least the age of majority in your state, or that you have the consent of a parent or guardian.
  • You may not use our products or site for any illegal or unauthorized purpose, or violate any law in your jurisdiction, including copyright law.
  • You must not transmit worms, viruses or any code of a destructive nature.
  • A breach of any of these Terms ends your right to use the site immediately.

2. General conditions

  • We may refuse service to anyone, for any reason, at any time.
  • Your content, other than credit card information, may be transferred unencrypted over various networks and changed to fit the technical needs of those networks. Credit card information is always encrypted in transit.
  • You may not copy, reproduce, sell, resell or exploit any part of the site, its use or access to it, without our written permission.
  • Headings are for convenience only and do not limit these Terms.

3. Orders, quotes and acceptance

  • An order is an offer to buy. We accept it when we ship the items or confirm acceptance in writing. We may refuse, limit or cancel any order for any reason, including product availability, errors, suspected fraud or an order that appears to come from a dealer, reseller or distributor.
  • We may limit quantities per person, household or order. These limits can apply to orders placed with the same account, card, or billing or shipping address.
  • If we cancel or change an order, we will try to notify you using the email, phone or billing address you gave us. A cancelled order is refunded in full unless it has already shipped.
  • Quote-only items. Some products, such as big brake kits, are sold by quote. A quote confirms the price, shipping and availability. The order is not accepted until you accept the quote in writing and we receive payment.
  • Special order and made-to-order items are ordered from the manufacturer or built after you buy. Lead times are estimates, and these items cannot be cancelled or returned once ordered.
  • You agree to give current, complete and accurate purchase and account information, including your email address, phone number and payment details, and to update it promptly so we can complete your order and reach you.

4. Prices, payment and errors

  • Prices and availability can change without notice. The price that applies is the price when we accept your order.
  • Payment is due when you order. We accept the payment methods shown at checkout. We may hold or cancel an order until we can verify the payment method and shipping address.
  • Occasionally the site or an order may contain a typographical error, wrong price, wrong shipping charge or wrong product information. We may correct it, cancel the order, or ask you to approve the corrected price or shipping, even after you have submitted your order or we have charged your card. If we cancel, we refund what you paid.
  • Product descriptions and photos are for general information. We try to show products and colors accurately, but we cannot guarantee that your screen shows them exactly.
  • We do not warrant that a product will meet your expectations. We may discontinue any product at any time, and any offer is void where prohibited.
  • Sales tax is collected where required by law.

5. Fitment, installation and use

  • Fitment is your responsibility. We list vehicle fitment as a guide. Before you order, confirm that the part fits your vehicle, wheels, ride height and use, including wheel clearance for brake kits and offsets for wheels. Contact us if you are unsure.
  • Professional installation. Performance parts must be installed by a qualified professional, following the manufacturer's instructions. Brakes, suspension, fuel, exhaust and safety equipment affect how your vehicle drives and stops. You are responsible for checking the installation and for safe use.
  • Off-road and competition use. Many products are intended for off-road or competition use only. It is your responsibility to confirm that a product is legal for your vehicle and your location, including emissions and noise rules. We do not sell products for use where they are illegal, and we are not responsible for fines, failed inspections or loss of manufacturer coverage on your vehicle.
  • Modified vehicles. Parts may behave differently on a modified vehicle. Fit, function and warranty are not guaranteed for vehicles with changes outside the product's intended application.
  • Exhaust sound and tone are subjective and are not grounds for a return or warranty claim.

6. Manufacturer warranty only

Products carry the manufacturer's warranty only. We do not add our own warranty, and we do not cover labor, installation, removal, towing or shipping costs from a warranty claim. Contact us first about a claim and do not remove an installed part before you have authorization, because many manufacturers deny claims on parts removed without it. We are not responsible for a manufacturer's decision on a claim.

7. Shipping, returns and refunds

Shipping, delivery, risk of loss, returns, refunds, restocking fees and cancellations are governed by our Shipping Policy and Return and Refund Policy. Both are part of these Terms. If these Terms and a policy conflict on shipping or returns, the policy controls. All returns require a Return Authorization (RMA) number, and special order and quote-only items cannot be returned.

8. Payment disputes

If you have a problem with an order, contact us first at help@millaracing.com or 610.400.3187 so we can fix it. If you file a chargeback with your bank or card issuer, we will give the issuer the records of your order, delivery and communication with us, including these Terms and our policies. Filing a chargeback while we are working on a resolution may delay that resolution.

9. Disclaimer of warranties and limitation of liability

  • We do not guarantee that your use of the site will be uninterrupted, timely, secure or error-free, or that the results from using it will be accurate or reliable. We may remove the site or any part of it at any time without notice.
  • Your use of the site is at your own risk. The site and all products and services delivered through it are provided "as is" and "as available", without any warranty or condition of any kind, express or implied, except as stated in section 6. This includes implied warranties of merchantability, fitness for a particular purpose, durability, title and non-infringement, to the extent the law allows us to disclaim them.
  • To the fullest extent the law allows, Millaracing and its directors, officers, employees, affiliates, agents, contractors, suppliers and service providers are not liable for any injury, loss, claim or any direct, indirect, incidental, punitive, special or consequential damages. This includes lost profits, lost revenue, lost savings, loss of data, loss of vehicle use, towing, rental vehicle costs, labor, and damage to a vehicle or other property. It applies whether the claim is based on contract, tort (including negligence), strict liability or otherwise, and arises from your use of the site or any product.
  • Our total liability for any claim relating to a product or an order is limited to the price you paid for that product.
  • Some states do not allow certain exclusions or limits of liability. In those states, our liability is limited to the maximum extent the law permits, and nothing in these Terms limits liability that cannot lawfully be limited.

10. Indemnification

You agree to indemnify, defend and hold harmless Millaracing, its parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, suppliers and employees from any claim or demand, including reasonable attorneys' fees, made by a third party because of your breach of these Terms or the policies they include, your violation of any law, your violation of a third party's rights, or your installation or use of a product.

11. Governing law and venue

These Terms, and any dispute about the site or your purchases, are governed by the laws of the Commonwealth of Pennsylvania and applicable federal law, without regard to conflict-of-law rules. You agree that the state and federal courts located in Montgomery County, Pennsylvania have exclusive jurisdiction over any dispute, and you consent to their jurisdiction and venue.

We may give you access to third-party tools that we do not monitor or control. Those tools are provided "as is" and "as available", without warranty or endorsement, and you use them at your own risk. Content, products and services on our site may include materials from third parties, and links may lead to third-party websites that are not affiliated with us. We are not responsible for their content, accuracy or practices, or for any harm or damages from transactions with them. Direct complaints and questions about third-party products to the third party.

13. User comments and submissions

If you send us comments, ideas, suggestions or other materials, by any means, you agree that we may edit, copy, publish, distribute, translate and otherwise use them in any medium without restriction. We are under no obligation to keep them confidential, pay for them or respond to them. We may, but need not, monitor, edit or remove content that is unlawful, offensive, threatening, defamatory, obscene or that violates anyone's rights or these Terms. You agree that your comments will not violate any third party's rights, contain unlawful or abusive material, or contain a virus or other malware. You may not use a false email address, pretend to be someone else, or mislead us or others about where a comment comes from. You are solely responsible for your comments.

14. Personal information

Your submission of personal information through the store is governed by our Privacy Policy.

15. Prohibited uses

In addition to other prohibitions in these Terms, you may not use the site or its content: (a) for any unlawful purpose; (b) to ask others to take part in unlawful acts; (c) to violate any international, federal, provincial or state regulation, rule, law or local ordinance; (d) to infringe our intellectual property rights or those of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or other malicious code; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or get around the security features of the site or the internet. We may end your use of the site for any prohibited use.

16. Intellectual property

The content on this site, including text, images, logos and product descriptions, belongs to Millaracing, our suppliers or their licensors, and is protected by law. Brand names and logos of manufacturers belong to their owners. You may not copy or use them except as the law allows or with written permission.

17. Accuracy of information

We are not responsible if information on this site is not accurate, complete or current. The material is for general information and should not be your only basis for a decision. We may change the content at any time but have no duty to update it, and you are responsible for checking for changes.

18. Severability, termination and entire agreement

  • If any part of these Terms is found unlawful, void or unenforceable, it is enforced as far as the law allows and the rest remains in effect.
  • These Terms apply until ended by you or by us. You may end them at any time by telling us you no longer wish to use our services or by ceasing to use the site. We may end them, and deny you access to the site, at any time without notice if we believe you have failed to comply. You remain responsible for amounts due up to the end date, and obligations incurred before termination survive.
  • Our failure to enforce a right or provision is not a waiver of it.
  • These Terms, together with the policies they include, are the entire agreement between you and us and replace any earlier agreements or communications. Ambiguities are not construed against the drafter.
